Terms and Conditions


Deposits:

The deposit paid is for the agreed design at the time of booking in.

All appointments are only booked in once we have received a deposit.

Either £20 per hour quoted or £100 for a full day of tattooing

ALL deposits are non-refundable.

 

 

ALL deposits are non-transferable to another date or time within 72 hours of the appointment.

ALL deposits are non transferable of the design and are for the design discussed prior to payment.

Deposits can not be transferred between customers or artists.

Should you become unable to be tattooed or pierced either due to pregnancy, ill health confirmed by a doctor, or other we will hold your deposit for a maximum of one year form the date we have seen written communication or until there is a suitable time for you to rebook, at the owners discretion.

Should you need to move your appointment, giving more than 72 hours notice, we will allow a maximum of 2 new dates. After this you will lose your deposit and a new deposit will be required to rebook the appointment.

If you are more than 15 minutes late for your appointment we may be unable to tattoo you. Your deposit will be lost and a new appointment and deposit will need to be made.

Pregnancy or breastfeeding: 

You can not get a tattoo whilst being pregnant or breastfeeding. Should you become pregnant after paying your deposit, upon proof in the form of a letter from your GP/ midwife we will validate your deposit for up to 1 year. Should the original artist you booked in with no longer be working at Cold Iron, we will move the deposit to Shane or Nicola. Owners of Cold Iron. You may choose Shane or Nicola to complete the tattoo.

 Alcohol or Drugs: 

If you attend the studio and we believe you are under the influence of alcohol or drugs we reserve the right to turn you away. You deposit will be forfeit and it is up to the artist if they wish to rebook you for another time.


Vouchers:

GIFT VOUCHER TERMS AND CONDITIONS – Gift vouchers are valid for 12 months from date of issue. Unused values will not be refunded or attributed to any transactions after the expiry date. Due to coronavirus we will be extending all gift vouchers for as long as we have been forced to close.

– Gift vouchers can be redeemed against tattoos, tattoo aftercare and laser tattoo removal only at Cold Iron Tattoo Company

– Gift vouchers cannot be redeemed for cash, returned for a refund, have their balances consolidated to a new voucher or be replaced after expiry and are not legal tender.

– If your purchase exceeds the value of the gift voucher, balance must be paid by cash or bank transfer.

– If you return any products you have purchased using a gift voucher, the balance will be credited to you as a credit note and is to be redeemed against subsequent purchases.

– Gift vouchers cannot be replaced if lost or stolen. If you suspect an unauthorised activity, immediately report this to Cold Iron Tattoo Company or email coldirontattooco@gmail.com providing all details including proof of purchase, gift voucher number and a photo ID for verification purposes.

– Cold Iron Tattoo Company reserves the right to cancel a gift voucher if we deem such action necessary. If so, we may either provide a replacement gift voucher of equivalent value unless we suspect fraud in relation to a gift voucher. The gift voucher remains our property.

– Cold Iron Tattoo Company can vary or replace these conditions from time to time (including to introduce new fees)

Making A Purchase
Making a purchase could not be easier. Just browse our store and add any items that you wish to buy into the shopping cart. After you have finished your selection, click on ‘Checkout’ and you will be asked for a few details that we need to be able to complete the order.
We accept payment by card or paypal online however if you do not wish to pay online, you may place the order via phone 01603 630503 and pay cash into the studio. If you have made a mistake in your order and cannot correct it in the shopping cart, contact us and we will correct the mistake.When confirmation of your order is received, this is to indicate that we have received your order. It does not indicate that a contract exists between us. We will indicate acceptance of your order, and hence a contract between us, when we send you an email. We have included this term to protect us in the case that a mistake has been made in pricing, we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason. In the case of a change of price, we will always contact you first to ensure that the price is acceptable.The Contract shall be on these Terms to the exclusion of all other terms and conditions, including any such terms and conditions that are purported to be included or applied by the Buyer.
No terms and conditions contained in the confirmation of order, purchase order or other document of the Buyer will form part of the Contract.Risk in the Goods shall pass to the Buyer on delivery
Ownership in the Goods shall not pass to the Buyer until the Company has received in full in cleared funds all sums due to the Company in respect of the Goods and all other sums which are or may become due to the Company from the Buyer on any account.
Until ownership of the Goods has passed to the Buyer, the Buyer shall:
hold the Goods on a fiduciary basis as the Company’s bailee;
store the Goods separately from all other goods of the Buyer or any third party in such a way that they remain identifiable as the Company’s property;
not destroy or deface any identifying mark on the Goods or their packaging;
maintain the Goods in satisfactory condition insured with the Company’s interest noted on the policy and hold any proceeds of such insurance on trust for the Company and not mix them with any other money.
The user must at all times be satisfied that the goods ordered are suitable. The company cannot accept liability for the way the products are stored or used.The Company’s liability in contract, tort or otherwise arising out of the subject matter of the Contract shall not exceed £1000 and the Company shall under no circumstances be liable to the Buyer for any consequential, indirect or economic loss or damages.We recommend spot testing or consultation with a dermatologist prior to use of any tattoo inks, or aftercare.If either party is subject to an event of Force Majeure, that is circumstances outside its reasonable control, including but not limited to war, fire, industrial disputes or civil commotion, it shall notify the other and the first party’s obligations under these Terms shall be suspended until it notifies the other party of the end of such event of Force Majeure.

Currently we only ship to the U.K

We reserve the right to request extra shipping payment depending on the total weight of the order and our courier’s charges. We will however email you to let you know of any extra shipping payment required and you have the right to cancel your order if you wish.

Delivery Schedule
UK MAINLAND ORDERS
All order placed before 3pm will be despatched on a next working day service providing we have your item in stock. You will be notified via email should your item not be in stock.
You must inform us within two working days if the goods are lost or damaged in transit so that we can make a prompt claim against the delivery company and correct the problem. Please quote your order number in all correspondence. The proof of delivery supplied by our delivery company is sufficient evidence to establish that goods have been received.
Back Orders
If your item is not in stock we will notify you via email with an alternative or an option to cancel your order and accept a refund.
Tax Charges
For orders made from the UK or the European Union, 20% VAT is added.
Credit Card Security
When the order is placed on our website, credit card numbers are encrypted using 128 bit encryption. They are only decrypted after they reach our computer. They are not held in clear text on any web site.
Our Merchant Only accepts 3D Secure transactions.Merchant Services require CVV2/CVC2 verification.All credit/debit card information is given over a secure merchant page.Merchant services are responsible for all our Website transactions.
Warranties
The Company warrants that the Goods are of satisfactory quality.
If the Buyer wishes to make a claim under this warranty, the Buyer shall give written notice to the Company within 30 days of the discovery of the defect and give the Company a reasonable opportunity to inspect the Goods in question.
The Company shall not be liable for any breach of warranty if the Buyer makes any further use of the Goods after giving such notice or alters or repairs the Goods without the agreement of the Company.
The Company’s liability under the warranty shall be limited to arranging repairing or replacing the Goods in question or refunding the price of such Goods.

Returns Policy Returns

 

Your rights to return goods are protected under the EU Distance Selling Directive.

You are entitled to cancel your order and return the goods within 7 working days for a full refund, including the cost of delivery. Do this by contacting us by email or telephone and quoting the order number supplied to you. Your refund will be paid within 30 days. You are responsible for the cost and risk of loss or damage when returning the goods, so you should take out enough postal insurance to cover their value. This cancellation policy does not affect your rights when we are at fault – for example, if goods are faulty or misdescribed.

Any goods returned should be in saleable condition.

These terms apply to your order. We may change our terms and conditions at any time, so please do not assume that the same terms will apply in the future. None of these terms affect your legal rights and these are not diminished in any way. If any term is held to be invalid under any applicable statute or rule of law, that term is automatically omitted from the terms to minimum extent necessary to comply with the law and without affecting the validity or enforceability of the remainder.

Interpretation
In these Terms and Conditions (Terms), the following words and phrases shall have the following meanings:
“the Buyer” means the person, firm or company who purchases the Goods from the Company:
“the Company” means Cold Iron Tattoo Company and any associated trading names
“Contract” means the contract between the Company and the Buyer which shall be deemed to incorporate these Terms;
“Goods” means any goods agreed in the Contract to be supplied by the Company to the Buyer;
“Place of Delivery” means the place to which the Goods are to be delivered.
In these Terms, reference to any statute or statutory provision shall be construed as a reference to such statute or statutory provision as amended, modified, re-enacted or replaced from time-to-time.
